Relationship with Shopify

The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify, as well as with third parties that may be located in countries other than where you live, in order to provide and improve the Services for you. In addition, to help protect, grow and improve our business, we use certain Shopify enhanced features that incorporate data and information obtained from your interactions with our Store, as well as with other merchants and with Shopify. To provide these enhanced features, Shopify may use personal information collected from your interactions with our store, with other merchants and with Shopify. In these circumstances, Shopify is responsible for the processing of your personal information, including for responding to your requests to exercise your rights over the use of your personal information for these purposes. Third-party websites and links

The Services may provide links to websites or other online platforms operated by third parties. If you follow links to sites that are not affiliated with or controlled by us, we recommend that you review their privacy and security policies and their other terms and conditions. We do not guarantee and are not responsible for the privacy or security of such sites, including the accuracy, completeness or reliability of the information found on them. Our inclusion of such links does not in itself imply any endorsement of the content of these platforms or of their owners or operators, unless otherwise stated on the Services.

Children's data

The Services are not intended to be used by children, and we do not knowingly collect any personal information about children under the age of majority in your jurisdiction. If you are the parent or guardian of a child who has provided us with their personal information, you may contact us using the contact details set out below to request its deletion. Security and retention of your information

Please be aware that no security measure is perfect or impenetrable and that we cannot guarantee “perfect security”. In addition, any information you send us may not be secure while in transit. We recommend that you do not use unsecured channels to communicate sensitive or confidential information to us.

How long we retain your personal information depends on different factors, such as whether we need the information to manage your account, to provide you with the Services, to comply with our legal obligations, to resolve disputes or to enforce other applicable contracts and policies.

Your rights and choices

Depending on where you live, you may have some or all of the rights listed below in relation to your personal information. However, these rights are not absolute, may apply only in certain circumstances and, in certain cases, we may decline your request as permitted by law.

  • Right of access / right to know. You may have the right to request access to the personal information we hold about you.
  • Right to erasure. You may have the right to request that we delete the personal information we hold about you.

You can exercise your rights to opt out of these uses here. Please note that if you visit our website with the Global Privacy Control opt-out preference signal enabled, depending on where you live, we will automatically treat this as an opt-out request for the device and browser you use to visit the website. If we are able to associate the device sending the signal with a Shopify account, we will also apply the opt-out request to that account. To learn more about Global Privacy Control, you can visit https://globalprivacycontrol.org/. Other than Global Privacy Control, we do not recognise other “Do Not Track” signals that may be sent from your web browser or device.
  • Managing communication preferences. We may send you promotional emails. You can choose to stop receiving them at any time by using the unsubscribe option included in our emails. • Objection to processing and restriction of processing: You may have the right to ask us to stop or restrict the processing of your personal information for certain purposes.
  • Withdrawal of consent: Where we rely on your consent to process your personal information, you have the right to withdraw that consent. If you withdraw your consent, this will not affect the lawfulness of processing based on your consent before its withdrawal.

You can exercise these rights where indicated on the Services or by contacting us using the contact details provided below. To learn more about how Shopify uses your personal information and the rights you may have, including rights relating to data processed by Shopify, you can visit https://privacy.shopify.com/fr.

We will not penalise you for exercising any of these rights. We may need to verify your identity before we can process your requests, as provided for or permitted by applicable law. In accordance with applicable law, you may designate an authorised agent to make requests on your behalf to exercise your rights. Before accepting such a request from an agent, we will require the agent to provide proof that you have authorised them to act on your behalf, and we may ask you to verify your identity directly with us. We will respond to your request within the time limits set by applicable law.

Complaints

If you wish to make a complaint about how we process your personal information, please contact us using the contact details set out below. Depending on where you live, you may have the right to appeal our decision by contacting us using the contact details set out below, or to lodge a complaint with the competent data protection authority in your area. For the EEA, you can find a list of the responsible data protection supervisory authorities here.

International transfers

Please note that we may transfer, store and process your personal information outside the country in which you live.

If we transfer your personal information outside the European Economic Area or the United Kingdom, we will rely on recognised transfer mechanisms such as the European Commission's Standard Contractual Clauses, or where applicable any equivalent contract issued by the competent UK authority, unless the data transfer is to a country recognised as providing an adequate level of protection.

Changes to this Privacy Policy

We may update this Privacy Policy at any time, including to reflect changes to our practices or for other operational, legal or regulatory reasons. We will post the revised Privacy Policy on this website, update the “Last updated” date and provide notice as required by applicable law.

Images generated by artificial intelligence

The site offers AI-assisted creation tools. When you request an image from a photo, a reduced version of that photo is sent to our technical service provider for the time it takes to produce the image, and is then not kept by this processing. A technical label is also sent to us (image format, resolution, number of faces detected), so that we know what our tools need to be able to do. Keeping a copy of uploaded photos, only with your consent, is described in the “Uploaded photos” section below.

On the other hand, when you ask the site's artificial intelligence to produce an image, that generated image and the written request that produced it may be kept by Pose ton design to understand and improve the service. They are not used commercially and are not used by Pose ton design to train an artificial intelligence model.

The legal basis for this retention is our legitimate interest in improving the tool. You can request the deletion of a generated image concerning you, or object to its retention, by writing to us using the contact details set out below.

Uploaded photos

What we keep. If you have accepted audience measurement, a reduced copy of each photo you upload to the personalisation tool (studio or AI creation) is sent to our servers (1,280 pixels maximum). It is accompanied by technical information unrelated to your identity: a session identifier that disappears when the tab is closed, the source of the visit, the country inferred from the connection, the type of device (mobile or computer), the product chosen and the dimensions of the image. Neither your name, nor your email address, nor your IP address is associated with this copy.

Your consent. This copy is kept only if you have accepted audience measurement: “Accept” button on the cookie banner, or “Analytics” box in the settings opened via the “Cookies” link at the bottom of the page. The banner states: “Uploaded photos are kept for 14 days.” If you refuse, or as long as you have not responded, no copy is kept. Refusing does not prevent you from using the tool or ordering.

Why. To understand what visitors are trying to create and to improve the personalisation tool and support: photo quality, formats, difficulties encountered.

Legal basis. Your consent.

Duration. 14 days, then automatic deletion.

Who has access. The site publisher only. The copy is not resold, transferred or published. It is not used for advertising or commercial purposes, nor to train an artificial intelligence model.

Where. The copies are stored with our hosting provider Cloudflare (Cloudflare, Inc.), in a database located in Western Europe. As Cloudflare is a company established in the United States, access from that country cannot be ruled out. This transfer is governed by the EU–US Data Privacy Framework and by the European Commission's Standard Contractual Clauses.

Withdrawing your consent, having a copy deleted. You can withdraw your consent at any time, without having to give a reason, via the “Cookies” link at the bottom of the page: no further copies are kept after that. Withdrawal does not affect copies kept previously, which are in any case deleted after 14 days. To have a copy already kept deleted sooner, write to us via the contact form (posetondesign.fr/pages/contact), stating if possible the approximate date and time of the upload: we cannot link a photo to your name.

Photos of third parties and minors. Do not upload a photo of a person without their consent, or of a minor without the consent of their legal representatives.
