GENERAL TERMS AND CONDITIONS OF SALE
These terms govern sales concluded on the websites posetondesign.fr (France) and posetondesign.co (international) between Pose ton design, a sole proprietorship operated by Atelier Beaumur, and any consumer customer. The seller's full details are given on the Contact information page. Placing an order constitutes acceptance of these terms.
2. OUR PRODUCTS
We sell items printed individually from an image supplied by the customer: clothing, mugs, bags, posters. No item is made in advance. The essential characteristics of each product are shown on its product page.
3. PRICES
Prices are shown in euros, or in the currency of the delivery country on posetondesign.co (pounds sterling in the United Kingdom, Swiss francs in Switzerland, US dollars in the United States, Canadian dollars in Canada). Delivery is included in the price shown for all destinations served: France, the European Union, the United Kingdom, Switzerland, the United States and Canada. The price shown is the price paid: no charges are added at payment.
Outside the European Union (United Kingdom, Switzerland, United States, Canada), customs duties or import taxes may apply on receipt, depending on the country. They are set by the destination country and are payable by the recipient.
VAT not applicable, Article 293 B of the French General Tax Code (Code général des impôts). Pose ton design operates under the VAT franchise scheme for small businesses (franchise en base de TVA). Prices are net of tax.
4. ORDER
The sale is concluded when the customer confirms their order and payment, after having been able to check the details of the order and correct any errors. A confirmation email summarising the order is sent immediately.
Before confirming, the customer sees a preview of their personalised item. This preview is authoritative: it is this image that goes into production.
5. PAYMENT
Payment is made online, at the time of ordering, using the methods offered at checkout. The order is processed only once payment has been received.
6. NO RIGHT OF WITHDRAWAL FOR PERSONALISED PRODUCTS
Pursuant to Article L221-28, 3° of the French Consumer Code (Code de la consommation), the fourteen-day right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalised. All items sold on this site fall into this category: they are made individually from the customer's image and cannot be resold.
The customer is informed of this before confirming their order and expressly accepts it.
As long as the order has not gone into production, it can be cancelled on simple request, with a full refund.
7. LEGAL GUARANTEES
The customer benefits from the legal guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code) for two years from delivery, and from the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code) for two years from the discovery of the defect. Details of the remedies are given in the return and refund policy.
8. YOUR IMAGE, YOUR RIGHTS
By uploading a file, the customer warrants that they hold all the rights necessary for its reproduction: copyright, related rights, image rights of the people depicted, rights in trademarks and logos. They indemnify Pose ton design against any third-party claim in this respect.
The customer grants Pose ton design a licence strictly limited to producing their order. We never use a customer image for any other purpose, in particular advertising, without their prior written consent. The only exception: if the customer has accepted audience measurement, a reduced copy of the uploaded photo is kept for 14 days, solely to improve the site, under the conditions of Article 11.
We reserve the right to refuse any order whose image is manifestly unlawful, infringing, or contrary to human dignity. The order is then refunded in full.
9. QUALITY OF THE FILE PROVIDED
We print the file as it is sent to us. A low-resolution image will give a low-resolution print. The personalisation tool warns the customer before ordering when the resolution is insufficient. This case does not constitute a lack of conformity.
10. DELIVERY
Lead times and terms are set out in the shipping policy. Production and shipping are handled by our partner printer Gelato, whose network produces each item as close as possible to the delivery address.
11. PERSONAL DATA
Data processing is described in the privacy policy. Uploaded images and delivery details are passed to Gelato solely for the purpose of fulfilling the order.
If the customer has accepted audience measurement (“Accept” button on the cookie banner, or “Analytics” box in the settings opened via the “Cookies” link at the bottom of the page), a reduced copy of each photo uploaded to the personalisation tool (1,280 pixels maximum) is kept by Pose ton design for 14 days, then automatically deleted, in order to improve the site and support. If the customer refuses, or as long as they have not responded, no copy is kept. This copy is accessible only to the site publisher. It is not resold, not used commercially, and not used to train an artificial intelligence model. The customer can withdraw their consent at any time via the “Cookies” link at the bottom of the page, and request deletion of a copy already kept via the contact form (posetondesign.fr/pages/contact).
12. COMPLAINTS AND MEDIATION
Any complaint must be sent in writing to the address given in the Contact information. Failing a satisfactory response, the consumer customer may use, free of charge, the consumer mediator whose details are given on the Contact information page, in accordance with Article L612-1 of the French Consumer Code.
13. GOVERNING LAW
These terms are governed by French law. In the event of a dispute, the French courts have jurisdiction, without prejudice to the rules protecting consumers.
14. PROCESSING OF CONTENT BY ARTIFICIAL INTELLIGENCE
The site offers AI-assisted creation tools. By uploading content and then requesting a transformation, a generation or a background removal, the customer expressly authorises Pose ton design and its technical service providers to reproduce, adapt, crop, cut out, retouch and transform this content by automated means, solely for the purpose of producing the requested image and manufacturing the ordered item.
This authorisation is non-exclusive, limited to these purposes, and ends when the order has been fulfilled. It does not entail any transfer of rights: the customer remains the owner of their original content.
The result produced by the tool is an automatic proposal, which may contain inaccuracies or differ from the original content. The customer checks it before ordering: the preview they approve is authoritative, in accordance with Article 4.
Images generated by the site's artificial intelligence, as well as the written request that produced them, may be kept by Pose ton design to understand and improve the service. They are not used commercially and are not used by Pose ton design to train an artificial intelligence model. Files uploaded by the customer follow the rules of Article 11 (reduced copy kept for 14 days, only with the customer's consent).
